Frequently Asked Questions
What is MIAM?
MIAM stands for Mediation Information and Assessment Meeting. It is the first step in the mediation process for those considering mediation to resolve family disputes, such as those related to divorce, separation, or child arrangements.
During a MIAM, a qualified mediator explains what mediation is, how it works, and assesses whether it is suitable for your situation. The meeting provides an opportunity for you to ask questions and understand if mediation could be a better alternative to going to court. It also allows the mediator to determine if your case is appropriate for mediation or if another form of dispute resolution might be more suitable.
In most cases, attending a MIAM is a legal requirement before applying to the family court for certain orders, such as those concerning children or financial matters, unless you are exempt.
Does my ex-partner have their own MIAM?
Yes, your ex-partner will typically have their own Mediation Information and Assessment Meeting (MIAM).
Each party attends a separate MIAM to ensure they have the opportunity to discuss their situation privately with the mediator. During their MIAM, your ex-partner will also receive information about mediation, how it works, and whether it is suitable for your specific circumstances. This separate meeting allows the mediator to understand each party's perspective and assess if mediation is appropriate for both of you.
After both parties have attended their individual MIAMs, if mediation is deemed suitable, you may then proceed to joint mediation sessions to work through your issues together.
How many sessions will we need?
The number of mediation sessions you will need depends on the complexity of your situation and the number of issues you need to resolve. Typically, most couples require between 2 to 4 sessions to reach an agreement. Each session usually lasts about 1 to 2 hours.
Here are a few factors that can influence the number of sessions required:
-
Complexity of Issues: If you have multiple issues to resolve, such as financial arrangements, property division, and child custody, you may need more sessions to cover everything thoroughly.
-
Level of Agreement: If you and your ex-partner are already in agreement on many points or willing to negotiate, fewer sessions may be needed. However, if there are significant areas of disagreement, more sessions might be required.
-
Communication and Cooperation: The willingness and ability of both parties to communicate openly and cooperate during sessions can affect the number needed. Mediation aims to facilitate a constructive dialogue, which can speed up the process.
-
Additional Complications: Situations involving high conflict, complex financial arrangements, or other unique factors may require additional sessions to ensure a fair and comprehensive agreement.
Your mediator will be able to give you a better idea of the number of sessions required after your initial Mediation Information and Assessment Meeting (MIAM).
Where will the sessions happen?
Mediation sessions with EB & Co. Mediation can take place either online or in person, depending on your preference and convenience.
-
Online Mediation: Many clients choose to have their sessions online via video conferencing platforms. This option offers flexibility, allowing you to participate from the comfort of your own home or any location that is convenient for you. It also eliminates the need for travel and can be more comfortable if you and your ex-partner prefer not to meet face-to-face.
-
In-Person Mediation: If you prefer face-to-face mediation, sessions can be held at our offices. From 2024, we will be based at our new offices at Rowe House in Saffron Walden. This provides a neutral, professional, and confidential setting for discussions.
Your mediator will discuss these options with you during your initial Mediation Information and Assessment Meeting (MIAM) and arrange a setting that works best for both parties.
